Frequently Asked Question about Delhi Health Service
Ques 1: Whether the Govt of National Capital Territory of Delhi has formed its own cadre?
Answer: Yes. The GNCT Delhi has decided to form its own cadre of doctors namely 'Delhi Health Service'.
Ques. 2: What shall be the constitution of Delhi Health Service (DHS)?
Answer: Initially, DHS will comprise of doctors appointed by GNCT, Delhi on contract basis and the doctors of Non-Teaching and GDMO sub-cadre of Central Health Service posted with GNCT, Delhi who have opted for DHS.
Ques 3: Whether the doctors of Teaching Sub-cadre of CHS posted with GNCT,Delhi would also be a part of DHS?
Answer: At present, the doctors belonging to Non-Teaching and GDMO sub-cadre of CHS who have opted for DHS would be joining DHS. Separation of Teaching Specialists sub-cadre will be considered at a later stage.
Ques 4: Whether the Govt of India has granted permission to GNCT,Delhi to form its own cadre 'DHS' with the doctors of CHS?
Answer: Yes. The Govt of India has conveyed its No Objection to the formation of 'Delhi Health Service' by GNCT, Delhi, initially with the doctors belonging to Non-Teaching and GDMO sub-cadre of CHS and posted with GNCT, Delhi.
Ques 5: Whether the Govt of India has granted permission to GNCT,Delhi to seek option form doctors of CHS?
Answer: Yes. The Govt of India has approved the draft advertisement to be issued by GNCT, Delhi for seeking options from CHS doctors posted with GNCT,Delhi.
Ques 6: What is the normal procedure of seeking option in case of formation of new cadre from existing cadre (CHS in this case)?
Answer: Normal procedure followed in case of formation of new cadre from existing cadre is to seek options from the incumbents holding postings in the proposed cadre. The same procedure is being followed in the case of formation of DHS out of CHS.
Ques 7: What shall be the Terms and Conditions of new Service?
Answer: Govt of NCT,Delhi has already mentioned in the Advertisement issued by them on 2.2.2007 for seeking option that the terms and conditions of the new service shall be similar to that of any other Group 'A' Service of GNCT,Delhi. However, the GNCT, Delhi has clarified that broadly speaking the terms and conditions of service for the members of the new Group 'A' service shall be similar to those of CHS doctors of Govt of India..
Ques 8: Whether RRs and cadre structure in DHS will be same as that of CHS?
Answer: The GNCT, Delhi has clarified that broadly speaking the terms and conditions of service for the members of the new Group 'A' service shall be similar to those of CHS of Govt of India.
Ques 9: Can an officer of CHS who opted for DHS, retain lien in CHS?
Answer: No.
Ques 10: Can a CHS officer who has opted to remain in CHS, be posted outside Delhi?
Answer: It has already been clarified in the advertisement issued by GNCT Delhi on 2.2.2007 for seeking options that doctors reverting to CHS from GNCT,Delhi are liable to be posted anywhere in India.
Quest 11: Where are vacancies available in CHS?
Answer: The details of vacancies in various sub-cadres of CHS are available on this Ministry's website (http//mohfw.nic/chs.html).
Ques 12: Whether the age of superannuation of Specialist doctors of CHS i.e 62 years, will remain the same in case of a CHS officer opted for DHS?
Answer: The age of superannuation has been enhanced by Central Govt in respect of doctors belonging to Specialists sub-cadre of CHS only. Once a doctor joins DHS, his service will be regulated by the Service Rules of DHS to be framed by GNCT, Delhi and RRs to be notified by GNCT,Delhi, in consultation with UPSC. So it cannot be said that the GNCT would adopt the age of superannuation as available in CHS, for DHS doctors. However, the GNCT, Delhi has clarified that broadly speaking the terms and conditions of service for the members of the new Group 'A' service shall be similar to those of CHS of Govt of India..
Ques 13: Whether the CHS doctors opting for DHS will be eligible for same post retirement benefits as in case of CHS?
Answer: Once a doctor joins DHS, his service including retirement benefits will be regulated by the Service Rules of DHS to be framed by GNCT, Delhi. So it cannot be said that the GNCT would adopt the same Rules as applicable to Central Govt employees. However, the GNCT, Delhi has clarified that broadly speaking the terms and conditions of service for the members of the new Group 'A' service shall be similar to those of CHS doctors of Govt of India.
Ques 14: Whether there will any change in Pay scale, NPA & promotional avenues on joining DHS?
Answer: Please see reply of Question-12.
Ques 15: Whether any Anomalies committee will be set up to settle the aberrations in future arising out of the constitution of Delhi Health Service?
Answer: Anomaly Committee is generally set up to settle the pay-anomalies arising out of implementation of recommendations of Pay Commission. Since this is not a case of implementation of Pay Commission recommendations, there arises no question to set up an Anomaly Committee.
Ques 16: How the inter-se-seniority of all those who opted for DHS would be fixed?
Answer: The matter of inter-se-seniority of all those who are appointed as part of the initial constitution of DHS shall be determined by GNCT, Delhi.
Ques 17: Whether an officer of CHS has to resign form CHS before joining DHS and if so, whether his application need to be routed through M/O Health & Family Welfare, GOI.
Answer: There is no need to resign from CHS. Once a CHS officer has opted for DHS, he would be deemed to have severed all connections with CHS and shall automatically be treated as having resigned from CHS technically. He need not require to submit any application to Ministry of Health & Family Welfare in this regard.
Ques 18: Whether the CHS has so many vacancies to accommodate the CHS officers reverting from GNCT, Delhi?
Answer: This will depend upon the number of officers who would like to remain in CHS.
Ques 19: Is it necessary for a CHS officer to route his/her application and bio-data for availing option through MOH &FW, GOI which is his cadre controlling authority?
Answer: No. It is not necessary for any CHS officer to route his/her application and bio-data for availing option through MOH &FW, GOI which is his cadre controlling authority. He/She can send his option directly to GNCT, Delhi.
Ques 20: What shall be effect for adoption in DHS to persons who have pending service related court cases.
Answer: The liability on this account shall be inherited by GNCT, Delhi.

GBM on 11-4-07 at 4PM at IMA Hall

DADWA had its GBM on 11-4-07 at 4PM at IMA Hall. Upon learning that the H&FW Dept. is going to form a committee to formulate service conditions of DADWA, it decided options would not be submitted till service conditions are notified and that each member of CHS would write to the Pr. Secretary (H) in this regard. Among other things, the GBM also agreed to the constitutional amends to make DADWA a broad-base body to represent all health institutions under GNCTD.

Members are aware that the last date for submitting the option for joining DHS is 15-4-07. DADWA is holding a GBM on Wednesday, April 11, 2007 at 4:00 PM at IMA Hall, IP Estate to inform the members of the latest development and advise the members accordingly.

It may be noted that 15-4-07 being a Holiday the last date stands extended to 16-4-07 automatically.

Further, the members might have gone through the minutes of the meeting of DADWA issued by teh Dy. Secretary (H) on 26-3-07. It may be noted that the GNCTD is committed to provide the service conditions to the CHS officers before 15-4-07 so that they can exercise their options with proper information. DADWA has requested the HM to issue appropriate directions in this regard. The Principal Secretary (H) has again taken some initiatives in this regard. GBM would be informed the details on 11-4-07

Sir,

I am a member of Central Health Service posted under GNCTD.
With reference to above said notice dated 2-2-07 and corrigendum thereof, I hereby state that I am awaiting declaration of terms and conditions of the Delhi Health Service by the H&FW Dept. of GNCTD before I exercise my option to join Delhi Health Service. I have learnt that the H&FW Dept. is going to formulate the R/R, terms and conditions of Delhi Health Service (DHS) in consultation with UPSC. I have also written a letter to my present cadre controlling authority viz. GOI MOHFW in this regard.


I understand that in a meeting with Delhi Administration Doctors' Welfare Association on 1-3-07, the H&FW Dept., among many other things, decided to make the terms and conditions of Delhi Health Service similar to that of Central Health Service. Consequently, the last date for submission of options was extended from 15-3-07 to 15-4-07 so as to make the said terms available to members of CHS like me before they exercise option to join Delhi Health Service.


In view of the said letter dated 26-3-07 of the DS (H), I believe requisite action is being taken. But, as 15-4-07 is fast approaching, I request you to provide me details of the terms and conditions of the DHS including Cadre-structure, identification of posts, recruitment rules, promotional avenues, career growth, pension and other benefits so that I am able to exercise my option to join DHS. Till then, kindly extend the last date of submission as well.

NEWS LETTER

Dear Friends.

JACSDO is back in this News Letter after a period of six months.

The three vital issues are pending in front of us

    1. Recommendations of Javed Choudhry Committee
    2. Cadre Review of Central Health Service
    3. VIth Central Pay Commission.

All of you are aware of that the two vital recommendations of Javed Choudhry Committee Report are under process and is in advance stage of implementation.

In this regard we want to inform you that two vital recommendations are (i) enhancement of retirement age of all CHS officers to 62 years (ii) to release stagnation at NFSG scale and put to SAG scale to those who have completed five years in NGSG scale till 31st March, 2006. The retirement age in respect of Specialist Sub Cadre has already been implemented and also the same will be extended to GDMO Sub Cadre very soon as it is in the advance stage of implementation. Regarding promotion to SAG scale for the incumbents who are stagnating at NFSG scale for more than five years till 31st March, 2006 is also in advance stage of implementation as necessary procedural formalities are being completed.

The other recommendations of Javed Choudhry Committee report is being pursued with VIth Central Pay Commission.

Our Association has prepared the document for VIth CPC on holistic manner and submitted to the Commission. We had audience with the Chairman and other Members of the VIth CPC on 14th Jan. 2007 where all issues were presented in a logistic manner.

Out of several proposals submitted to VIth Pay Commission we have pinpointed two vital proposals e.g. (i) to put to SAG scale on 9th year of service and 16th year of service for Specialist and GDMO sub cadre respectively. (ii) To upgrade, 50% of existing SAG posts of Central Health Service is also going on and we hope it will be finalized at the feedback from the different participating units of CHS. We also appeal to all the Head of the Department of the participating units to reply to the Ministry of Health & Family Welfare which they have asked from the different organizations in a format regarding cadre structure and its proposal. Recently the DPC is conducted for 25 posts of Professor/ Director of teaching Sub Cadre and 108 posts of SAG of GDMO Sub Cadre. The order of promotion is expected to be issued within one month. The DPC for posts of Consultant for non-teaching Sub cadre and 12 posts of Additional DGHS for four sub cadre of CHS is still pending and JACSDO is pursuing with the Ministry of Health & Family Welfare & UPSC for fixing the date of DPC at the earliest.

JACSDO is running short of funds and every activity of the Association is cost effective. We appeal to all of you to contribute @ Rs.1000/- per head in the name of JACSDO New Delhi" at the earliest so that we can pursue all the issues vigorously.

Need to make a representation by all members to the GOI MOHFW regarding the advertisement of GNCTD about Delhi health Service

A General Body Meeting of DADWA is being held on Sunday 25th March 2007 at 2 PM at IMA Hall to discuss the various developments since the last GBM held on 6-3-07. A number of queries were being received by the steering committee of DADWA regarding the need to make a representation by all members to the GOI MOHFW regarding the advertisement of GNCTD about Delhi health Service. Meanwhile DADWA has approached the Principal Secretary (H&FW) again to issue the minutes of its meeting with HM and him on 1-3-07 when some important decisions were taken. The minutes are likely to be issued shortly

The Govt. of NCT of Delhi vide its OM dated 18-12-06 has notified formation of “Delhi Health Service (DHS)”. Subsequently on 2-2-07 it issued a notice in ‘The Times of India’ followed by its corrigendum on 15-3-07 wherein ‘option’ has been sought from members of Central Health Service as to whether they wish to join DHS or remain in CHS. D.H.S. as per the said notice is a new group ‘A’ service with similar terms and conditions as that of Central Health Service and that if I do not opt before 15-4-07, I would be reverted back to CHS. I am given to understand that GNCTD has taken this decision in consultation with M.O.H.F.W. and the advertisement dated 2-2-07 was released after approval of MOHFW (CHS).

In the light of above, I request you to,

  1. Send me a copy of the terms and conditions of “Delhi Health Service” as approved by the GOI MOHFW either by post or by email at the earliest.
  2. Allow me to maintain lien with by parent cadre for the time being till I finally get absorbed in the Delhi Health Service, if I choose to do so in the light of service conditions of DHS.
  3. Guide me if I need to resign from CHS before I join the Delhi Health Service and whether my application should be routed through MOHFW GOI in case I respond to the said advertisement.
  4. Please advise: If I do not opt for the “Delhi Health Service”, and choose to remain in CHS,
    1. What would its possible impact on my service, pay, place of posting and career progression etc. since cadre posts of CHS under GNCTD would no more be there as these stand de-cadred as per OM dated 18-12-07 of GNCTD, thereby reducing the cadre strength of CHS?
    2. How many CHScadre posts at various levels would be available in Delhi?

Sir, the above notice has added uncertainty and is a source of anxiety for me. Last date is near and terms and conditions of “Delhi Health Service” are not yet known to me. Please provide me the above information at the earliest and also take up matter with GNCTD so that option is not forced on me till conditions of the said service duly notified.
